The New York State Department of Environmental Conservation (NYSDEC), in consultation with the New York State Department of Health (NYSDOH), has approved FMC’s Off-Site Investigation and Remediation Work Plan for 2021 Activities as part of the Middleport Environmental Remediation Program.

The options described within this Work Plan focus on advancing remediation in off-site Operable Units 2 (OU2)and 5 (OU5) as a priority, consistent with the 2019 Order on Consent and Administrative Settlement.
OU2 consists of Air Deposition Area 1, south of the Erie Canal and west of the Niagara/Orleans County Line, and OU5 consists of Culvert 105 and Flood Zone, including the Wooded Parcel, with 2021 priority activities proposed on properties north of the Erie Canal.
In addition to work in OUs 2 and 5, the Work Plan also contemplates the potential for certain work to be conducted in 2021 in other off-site OUs, subject to appropriate timing for work plan or design submittals with corresponding NYSDEC approval, as may be appropriate.
